General terms and conditions

HOTEL VIU (managed by Puhua SA, Villars)



The general terms and conditions of sale given below shall govern the contractual relationship between customers and Puhua SA, in its capacity as manager and operator of Hotel Viu. Only these terms and conditions of sale shall be valid, to the exclusion of all other terms and conditions of sale.

These terms and conditions of sale may be amended at any time without any obligation on the part of the hotel to inform customers of such amendments.

Field of application:

These terms and conditions shall apply to contracts and reservations in respect of the supply of restaurant, spa and accommodation services and any other associated services.

Hotel Viu is at your disposal to answer any questions relating to this document.



Requests to reserve accommodation, meals and events are made free of charge. Offers of services are drawn up solely for information purposes, and do not represent a contractual commitment on the part of the hotel; availability may not be guaranteed. Contracts with customers shall not be deemed to be concluded until the hotel has confirmed the availability of reservations requested by customers.

If the customer should not wish to make a firm reservation but to take an option on a stay or service, the hotel shall remain free to accept or refuse such an option. Such an option shall not be valid until confirmed in writing by the hotel. The option shall include an expiry date, after which neither the hotel nor the customer may assume any obligation. The option shall be deemed to be accepted if it is confirmed by the customer before the expiry date. Upon validation by the customer the option shall become a firm reservation.

Unless stated otherwise, our rates include: accommodation, service and VAT; tourist tax is excluded.

As a general rule, and unless indicated otherwise, our hotel offers include breakfast.

All our prices are given in CHF (Swiss Francs)

The tourist tax for most of the year is CHF 1.25 per child per night and CHF 3.30 per adult per night. In the summer, this rises to CHF 2.50 per child per night and CHF 5.80 per adult per night.



In order to process a reservation, we require the following:

- Your contact details, including your first and last names, telephone number, email address and credit or payment card number.

- A deposit of 50% of the total reservation amount (excluding tourist tax) for all accommodation reservations.

- Payment of 100% of the total amount (excluding tourist tax) if the reservation is made one week or less before arrival.

NB: Deposits and payments may be made by bank transfer or credit or payment card (paid directly to the hotel or via distance selling, carried out by the hotel and accepted by the customer).

The hotel shall reserve the right to impose a minimum length of stay during certain periods in the year.

By sending us your reservation request and contact details you declare that you have read and accept the cancellation policy given below. Upon receipt of the information, we shall send you detailed confirmation of the reservation. Please take the time to read and check this confirmation.



Cancellation by the customer:

Any cancellation made between 0 and 7 days before the arrival date shall incur the total cost of the reservation.

Any no show or early departure shall be invoiced at 100% of the nightly price


No Show: A no show refers to a situation in which the customer, having reserved a room, does not arrive at the hotel on the given date, without having cancelled the reservation.

Cancellation by Hotel Viu:

The hotel shall reserve the right to cancel the contract with immediate effect in the event of one of the circumstances listed below:

- Failure to respect the agreed contractual terms and conditions

- The provision of false or misleading information concerning a customer or customers

- Use of hotel premises that does not comply with the contract or the reservation

- An incidence of Force Majeure or any other event outside the control of Hotel Viu that renders it impossible to honour the contract and/or the reservation

NB: No damages or interest shall be payable to customers in the event of termination of contract or cancellation of the reservation justified by one of the reasons given above.

Any amendments to reservations, contracts or offers must be made in writing and accepted by the hotel.



The following payments shall be accepted, in addition to payments in cash (Swiss Francs or Euros):

Arrival: The hotel shall guarantee the availability of rooms and suites from 3 pm

Departure: Rooms and suites must be vacated by 11 am at the latest.

Special clauses:

*Early arrivals policy for City, Standard and Superior rooms:

- Early arrival before 1 pm: invoiced at 100% of the room rate applied by the hotel for the previous night.

*Late departures policy for City, Standard and Superior rooms:

- Late departures before 6 pm: CHF 85

- Late departures after 6 pm: invoiced at 100% of the room rate

*Early arrivals policy for Suites:

- Early arrival before 1 pm: invoiced at 100% of the room rate applied by the hotel for the previous night.

*Late departures policy for Suites:

- Late departures before 2 pm: CHF 85

- Late departures after 2 pm: invoiced at 100% of the room rate

Should the customer vacate the room later than the agreed departure time (11 am), the hotel reserves the right to invoice the additional time as described above, according to the category of room occupied by the customer.

Arrangements for late departures and early arrivals are made at the discretion of Hotel Viu, and shall be subject to availability.



All expenses and bills incurred in respect of the stay must be settled by customers on the day of their departure.

In the absence of any written agreement to the contrary between Hotel Viu and the customer offering an additional delay, all invoices issued by Hotel Viu for any of its services shall be payable upon receipt. They shall be sent by email, by post or by fax.



In the event of payment directly to the hotel upon your arrival, confirmed rates in non-local currency shall be converted to the hotel's currency upon payment, in accordance with the exchange rate used by the hotel, and may be subject to exchange rate fluctuations. Credit card fees may be subject to additional currency conversion charges and to banking institution or credit card fees at the time of monthly statements are processed; such charges and fees are outside the hotel's control and may affect the amount charged to your credit card. Where applicable, the reimbursement of a deposit or advance payment shall be subject to the exchange rate at the time of reimbursement and may differ from the exchange rate at the time the deposit or advance payment was made.



Hotel Viu is unable to guarantee the protection of personal data shared via the internet, in particular data sent by email that may be consulted or intercepted by third parties.

Customers shall authorise Hotel Viu to use their personal data in order to fulfil its contractual and legal obligations and to enable it to undertake any marketing communication it may deem necessary.

The use by third parties for advertising purposes of contact information published on Hotel Viu's website is forbidden. The operator shall reserve the right to prosecute should it receive unsolicited advertising material or information.



The customer's liability:

All customers shall be held liable to Hotel Viu for any loss or damage of any type whatsoever caused by themselves or by dependant third parties or third parties appointed by them.

The hotel's liability:

Hotel Viu shall not be held liable for contractual or non-contractual damages caused by minor or ordinary negligence. It shall not be held liable for indirect damages, loss of profit or other subsequent damage. Secondary liability for negligence by service providers and casual employees shall be excluded, insofar as far as this is legally permitted.

Any claims or dissatisfaction on the part of the customer relating to a hotel service must be communicated immediately to a member of staff, or at the latest upon the customer's departure from the hotel; should this not be the case the customer shall be deemed to have waived his or her rights.

The hotel shall not be held liable for the theft or alteration of objects brought into the hotel by the customer.

The hotel does not carry out any surveillance of the parking facilities made available to customers and, as such, shall decline any liability in the event of damage to customers' vehicles, even if the aforementioned vehicles are parked in designated hotel parking spaces.

The photographs and information presented on the hotel's website are not contractually binding.



Any belongings left at the hotel shall be sent to the customer solely upon the latter's request, at the customer's expense (paid to the hotel in advance) and all associated risks shall be borne by the customer. The hotel shall reserve the right to dispose of any lost property that remains unclaimed for longer than three months.



Rooms may be only used for the purpose of accommodation.



Animals* in public areas:

Dogs are allowed only on Hotel Viu's outside terrace.

Customers shall undertake to use the outside path to access the terrace with their pets*.

Animals* in rooms:

Dogs are accepted in our rooms at a supplement of CHF 20 per day per dog.

*Dogs are the only animals accepted by Hotel Viu.




Should one of the provisions of the contract or of these general terms and conditions be declared void, invalid or inapplicable, the remainder of the contract or of these general terms and conditions shall remain unchanged. Should a provision prove void, invalid or unenforceable, this provision shall be replaced by a new provision whose meaning shall be as close as possible to the original provision that has been declared void, invalid or unenforceable.

Governing law and competent jurisdiction:

This contract shall be governed exclusively by Swiss law. In the event of a dispute, any legal action may be brought solely before the competent judicial authorities of the canton of Vaud, and the exclusive place of jurisdiction shall be Villars-sur-Ollon.
